Terms of Service

1. The service

SociGaps is an AI-assisted market opportunity and social intelligence platform. Features may include brand configuration, connected-account integrations, competitor intelligence, gap detection, campaign generation, collaboration, scheduling, reporting, subscriptions and related services. Features may vary by plan, account, jurisdiction, connected platform and release stage.

2. Eligibility and authority

You must be at least 18 years old or the age of legal majority where you live. If you use SociGaps for an organization, you represent that you have authority to bind that organization and to connect any business account, Page, profile, website, data source or other property you add to the service.

3. Accounts and security

You are responsible for keeping your account credentials secure, providing accurate information and promptly notifying us of suspected unauthorized access. You may not share administrator credentials with unauthorized persons or bypass workspace access controls.

4. Connected platforms

SociGaps may integrate with Meta and other third-party platforms. Your use of those platforms remains subject to their own terms, permissions, policies, technical limits and availability. SociGaps does not control third-party APIs and cannot guarantee that a particular account, metric, feature or competitor will remain accessible.

You must not provide us with a social-network password where an official authorization flow is available. You are responsible for ensuring that you have the right to connect and act on any account you authorize.

5. Competitor and public-data intelligence

SociGaps may analyse permitted public or API-accessible business information. Results are analytical signals, not a representation that SociGaps has access to private competitor data, sales, reach, saves, conversions or other owner-only information. Opportunity scores and explanations are estimates and should not be treated as guaranteed predictions.

6. AI output and human review

AI-generated or AI-assisted output can be inaccurate, incomplete, outdated or unsuitable. You are responsible for reviewing all campaigns, claims, images, scripts, hashtags, recommendations and other output before using or publishing it. SociGaps does not guarantee virality, engagement, leads, sales, ROAS, ranking or any other business result.

SociGaps is not a substitute for legal, medical, financial, regulatory or other professional advice. Users remain responsible for advertising claims, disclosures, intellectual-property clearance and platform compliance.

7. Your content and brand material

You retain ownership of material you upload or submit, subject to rights held by third parties. You grant SociGaps a limited, non-exclusive right to host, process, reproduce and transform that material only as necessary to provide, secure and improve the service for you. You represent that you have the rights needed for material you provide.

8. SociGaps intellectual property

SociGaps, its software, user interface, scoring methods, documentation, branding and proprietary technology are owned by Qort Inc. or its licensors. These Terms do not transfer ownership of SociGaps intellectual property to you.

9. Acceptable use

You must comply with our Acceptable Use Policy. Among other things, you may not use SociGaps for unauthorized scraping, credential theft, platform manipulation, harassment, infringement, deceptive impersonation, illegal discrimination, spam, malware or other unlawful activity.

10. Plans, billing and credits

Paid plans may be billed monthly, annually or on another stated basis. Plans may include limits for brands, competitors, users, scans, AI credits, media generation or other usage. Applicable fees, taxes, renewal terms, cancellation options and overage charges are shown at purchase or in the application. Unless required by law or expressly stated otherwise, fees for completed billing periods are non-refundable.

11. Trial and pilot functionality

Pre-release, beta, demo or pilot features may be identified in the interface. Simulated or demo data will be labelled and must not be represented as live social-platform performance. We may change or discontinue pilot functionality as the product develops.

12. Privacy

Our handling of personal data is described in the Privacy Policy. Meta-connected data is subject to additional platform requirements described on our Meta Integration & Permissions page.

13. Confidentiality

Each party will use reasonable care to protect non-public confidential information received from the other and will use it only for purposes connected with the service, except where disclosure is authorized or legally required.

14. Suspension and termination

We may restrict or suspend access where reasonably necessary for security, non-payment, legal compliance, platform policy compliance, suspected abuse, or material breach of these Terms. You may stop using SociGaps at any time and may request deletion in accordance with our Data Deletion instructions.

15. Service availability

We aim to operate SociGaps reliably but do not warrant uninterrupted or error-free access. Third-party APIs, hosting providers, AI providers and social networks may experience outages, change permissions or rate limits, or remove features without our control.

16. Disclaimer of warranties

To the maximum extent permitted by law, SociGaps is provided on an “as available” and “as is” basis. We disclaim warranties that are not expressly stated, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, to the extent such exclusions are permitted by applicable law.

17. Limitation of liability

To the maximum extent permitted by applicable law, Qort Inc. and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, loss of profits, loss of goodwill or loss of data arising from use of SociGaps. Any statutory rights that cannot lawfully be excluded remain unaffected.

18. Governing law

These Terms are governed by the laws of India, without prejudice to mandatory consumer or data-protection rights that may apply in another jurisdiction. Subject to applicable law, courts having jurisdiction in SAS Nagar (Mohali), Punjab, India will have jurisdiction over disputes arising from these Terms.

19. Changes

We may update these Terms to reflect product, legal or operational changes. Material changes may be notified in the application or by email. Continued use after the effective date of updated Terms constitutes acceptance where permitted by law.
